The Control of Asbestos at Work Regulations (2002)
Regulation 4 became effective on the 21st May 2004
The regulation created a new legal duty to manage asbestos in non-domestic premises. The duty holder is the person responsible for building maintenance, a landlord, a facilities manager or a building manager etc. under the new regulation he/she must manage the risk from asbestos by;
• Identifying the presence of asbestos in the premises, the extent and condition
• Maintaining an up to date register/record of then ACMs (asbestos containing materials) location and condition
• Assessing the risk posed by any ACMs identified
• Preparing a detailed risk management plan for the ACMs identified
• Taking the relevant steps to put this plan into action
• Reviewing and monitoring the risk management plan periodically
• Providing this information on the condition and location of ACMs to anyone how is liable to work on or disturb them
